Based on the current legislation in the field of gambling, each administrative proceeding starts with the submission of a request with documents attached to it, specific and required for each specific proceeding. The request and the attachments are entered in the office of the Central Office of the National Revenue Agency (NAA), according to the Ordinance on the documents required for the issuance of a license under the Gambling Act (NDNILZH).
In the proceedings for issuing/changing a license in accordance with the procedure under Art. 22 of the Law on Gambling (LA), the NRA requires official opinions from the chairman of the State Agency “National Security”, the Minister of Internal Affairs and the chairman of the Bulgarian Institute of Metrology.
It should be borne in mind that when an opinion is required, the request for issuing/changing a license is sent together with a copy of the attached documents, and for issuing an initial license the opinion is provided within 30 days of receiving the request, and for a change of a license – within 14 days.
The documents attached to the request by the organizers of gambling games and activities should be presented in their entirety and prepared in accordance with the requirements of the applicable normative acts in the field of gambling.
The Law on Gambling does not provide for the possibility for the gambling operator to change a submitted request at its own discretion within the framework of an administrative proceeding. This would lead to the initiation of a new administrative proceeding for the conclusion of which the provision of Art. 22 of ХХ.
